Good searching there my dear watson.....
Honestly though that is some good sh*t you have found, very interesting reading, I think that ACS may have dealt the digital act a big blow as this may become a BIG issue with the politicians to gain points at the next election.

Contact your local politician me thinks and ask him his stance on the legal blackmailing by ACS and the new digital act (ref. filesharing and wrongful accusations).

It's a checklist given to the legal call centre monkeys so that they can figure out how likely it is they can screw cash out of someone like yourself whom they previously issued a letter too. They'll check your denial letter against it and work out a 'how likely are we to get our cash' score.

Maybe it's just me but I'd start gathering up the pennies, or ask them for a reduced settlement. Or if you're absolutely certain you didn't download it then supply them your PC/hard drive.

This is ridiculous. Surely an IP and an alleged time is not enough to actually prosecute? Besides, whats to stop you sending them the PC with a new HDD in, or performing industry standard data erasure on the HDD and re-installing your OS. Look on the net and consumer forums for advice from people who this has happened to, cause it just seems like a whitewash from my point of view.

I have seen errors on KCs part when they have accused people of downloading something and sent out letters, even though when an audit was performed there was no trace of the files or software to download such content, and no wireless to "hack". Also one of them was a business account, which again, did not have wireless.

I'd also be looking into whether KC have broken any rules by handing over your details in the first place.

I'd be inclined to tell them to get a court order to seize the PC lol!

You might want to post your question here: http://www.consumeractiongroup.co.uk/forum/acs-law/

Write to Karoo, tell them that you want to see the evidence they provided to ACS.

Additionally file a complaint (separate letter) with Karoo, tell them you're hugely ****ed off and you're thinking about canceling your account, demand compensation for having your privacy breached.

I'd be highly tempted to hire a lawyer; get them to write you a 2nd denial letter and discuss options for filing a legal or civil action against ACS. That will probably cost more than the £400 fine but these people are vultures and doesn't deserve any of your money, especially if you didn't do what you are accused of.

Show these ass hats you are going to fight it and they will back down.
