I work for Zen and I have 35Mb/s FTTC in a small village - No traffic shaping, no prioritsation from Zen Internet -You pay for a service that you get - not for one you dont.
Traffic shaping is illegal as it penalises those on lower spending tariffs because the whole purpose is to force end users to pay for higher priced services for streaming etc even though the end user may not use all their monthly bandwidth allocation that they pay for in their month charge.
Also, all KC unlimited local calls charging and eforced bundeling (known as a "tie") is illegal since it prevents competion for call services from other providers.
I have met with Ofcom on this matter and they agree and were prepeared to open an investigation but the communications provider I represented was offered the opportunity to wholesale lines from Kingston and decided not to pursue the investigation since they were losing business based on KC's actions and an investigation would have taken Ofcom several weeks to complete - not to mention the press coverage on KC !!!! - therfore, KC were forced to provide the Communicatuions Provider with the equivalent of Wholesale Line Rental.
KC have a legal obligation to provide the equivalent of Openreaches WLR3 services to other CP's that wish to fully own the retail relationship with the end user.
please see
http://www.cobuscommunications.co.uk/network_services/index.phpThat still doesnt take away the fact that KC are illegally forced bundling (tying) unlimited locals and lines at an additional £3.50 per month and not allowing the end user to make calls on a metered pay as you go basis unless you are Hull City Council then you get the choice - again illegal to discrimanate between end users types
BT would not be permitted to do this so why KC - Quid Pro Quo perhaps !!!!!!!
